Terms of use

These terms govern access to and use of the CarbonLab platform. A contract with a client may supplement them; where they differ, the contract prevails.
Access
Access is reserved for people to whom CarbonLab has issued login details: there is no open sign-up.
Login details are issued to an organisation, which keeps them confidential, limits their use to the people it authorises and reports any loss or misuse to support@carbonlab.ch without delay.
CarbonLab may suspend access in the event of use contrary to these terms or of a risk to the security of the service.
Permitted use
The platform is used to build, analyse and track the client organisation’s carbon footprint and climate strategy, and to produce its reports.
The reports and exports produced by the platform belong to the client, which may use and publish them freely.
Prohibited use
It is prohibited to:
- attempt to access another client’s data or unauthorised parts of the platform;
- systematically extract the emission factor database or other content, in particular by automated means;
- disrupt the operation of the service or circumvent its technical limits;
- transfer or share access with unauthorised people;
- use the platform for unlawful purposes.
Client data
The client remains the owner of the data it enters or imports into the platform.
CarbonLab processes it solely on the client’s behalf and according to its instructions, in order to provide the service, as a processor within the meaning of Article 9 of the Federal Act on Data Protection (FADP). It is hosted in Switzerland and is never sold, transferred or used for any other purpose.
The client ensures that it holds the necessary rights to the data it entrusts to the platform, in particular to any personal data it contains.
At the end of the contract, the data is returned to the client or deleted, at its request.

Confidentiality
CarbonLab treats each client’s data as confidential and discloses it to no third party, apart from its hosting provider and where the law requires it. Each party keeps confidential the non-public information it receives from the other.
Scope of the results
The results are estimates: a carbon footprint depends on the data entered and the emission factors chosen.
The targets proposed by the Strategy module are aligned with the criteria of the Science Based Targets initiative (SBTi), without validation by the SBTi, which can only be obtained by submitting a request to it.

CarbonLab does not issue verifications or certifications.
Intellectual property
The platform, its code, text, documentation and videos belong to CarbonLab or its licensors. The client receives a non-exclusive, non-transferable right of use for the term of the contract.
Third-party data included in the platform, such as emission factor databases or the medical device database, remains the property of its authors; its source is shown in the application.
Availability
CarbonLab strives to provide an available and reliable service, without guaranteeing uninterrupted availability. Interruptions may occur for maintenance, updates or incidents. No service level is guaranteed unless a contract expressly provides for one.
Liability
To the extent permitted by Swiss law, CarbonLab accepts no liability for indirect damage, for loss of data, profit or business, or for decisions taken on the basis of the platform’s results. Liability for damage caused intentionally or through gross negligence remains reserved (Art. 100 of the Swiss Code of Obligations).
Changes to these terms
CarbonLab may change these terms. The version in force is published on this page with its date, and any significant change is announced to clients before it takes effect.

These terms are governed by Swiss law.
